TERMS AND CONDITIONS OF USE OF THE EPICURUS FUND MANAGEMENT, INDEPENDENT ADVISOR, S.A.P.I. DE C.V. PLATFORM

Welcome to the Epicurus Fund Management, Independent Advisor, S.A.P.I. de C.V. digital platform. This document contains the Terms and Conditions that govern the use of our digital services. It is essential that you read them carefully, as access to and use of the website implies your express acceptance of them. These terms seek to ensure an environment of trust, regulatory compliance, and transparency between Epicurus and its users.
In accordance with the following clauses:
FIRST.- IDENTITY AND ADDRESS. Epicurus Fund Management, Independent Advisor, S.A.P.I. Independent Advisor, S.A.P.I. Independent Advisor (“Epicurus”) is a commercial company legally incorporated under Mexican law, domiciled at Goldsmith 40, Colonia Polanco, C.P. 11550, Mexico City, and registered with the National Banking and Securities Commission (CNBV) under folio number 111746 in the Registry of Investment Advisors.
SECOND.- ACCEPTANCE OF THE TERMS. By accessing, browsing, or using the website https://www.epicurus.com.mx and/or any other digital service provided by Epicurus (“the Platform”), the user (“User”) accepts these Terms and Conditions. If the User does not agree with these Terms and Conditions, they must refrain from using the Platform.
THIRD.- PURPOSE OF THE PLATFORM. The purpose of the Platform is to provide information and access to the investment advisory services offered by Epicurus, in accordance with applicable financial legislation. The information contained on the Platform is for informational purposes only and does not constitute personalized investment recommendations.
FOURTH.- USE OF THE PLATFORM. The User agrees to use the Platform in accordance with the law, morality, public order, and these Terms. The following are prohibited:
a) Using the Platform for illegal or unauthorized purposes;
b) Introducing viruses or any other technological component that may damage Epicurus’s infrastructure;
c) Reproducing, distributing, modifying, or commercially exploiting the contents without prior authorization.
d) Placing or using the Portal’s Services and Content on your own or third-party sites or pages without prior written authorization from Epicurus;
e) Restricting or preventing other users from using the Portal.
The User is solely responsible for the creation, management, and confidentiality of their access credentials, including passwords and any other means of authentication. Epicurus will not be liable for unauthorized use of the User’s account resulting from negligent management or sharing of their credentials.
FIFTH.- PERSONAL DATA PROTECTION. Personal data is processed in accordance with the Privacy Notice available at https://www.epicurus.com.mx/avisoprivacidad/. Epicurus collects, uses, stores, and protects personal data in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties. Users may exercise their ARCO rights (access, rectification, cancellation, and objection) in accordance with the procedures established in said Notice.
SIXTH.- LIMITATION OF LIABILITY. Epicurus does not guarantee that the Platform will be error-free or uninterrupted. Under no circumstances will it be liable for indirect damages, loss of data, or profits arising from the use or inability to use the Platform. The information published does not constitute individualized legal or financial advice.
SEVENTH. – REGULATORY OVERSIGHT. Pursuant to Article 24 of the General Provisions Applicable to Investment Advisers, please be advised that the CNBV only supervises third-party securities portfolio management services and securities investment advisory services. Other services offered by Epicurus are not subject to direct supervision by the CNBV.
EIGHTH. INTELLECTUAL PROPERTY. All content on the Platform, including trademarks, logos, text, graphics, images, software, and design, is the property of Epicurus or licensed. Unauthorized use is prohibited.
NINTH. SECURITY MEASURES. Epicurus has implemented technical, administrative, and physical security measures to protect personal information against damage, loss, alteration, destruction, or unauthorized use, access, or processing. Epicurus also requires its service providers to comply with the necessary security measures to protect such information.
TENTH. PERFORMANCES AND SIMULATORS. The performance shown on the Platform is for informational purposes only and does not guarantee future results. Any tool, simulator, or projection available is for educational purposes and should not be considered a guarantee of profitability. The User should consult a professional advisor before making investment decisions.
ELEVENTH. MODIFICATIONS. Epicurus reserves the right to modify these Terms and Conditions at any time. Changes will be notified through the Platform or by direct communication, and will become effective upon publication.
TWELFTH.- APPLICABLE LAW AND JURISDICTION. These Terms are governed by the laws of the United Mexican States. For the resolution of disputes, the parties submit to the competent courts in Mexico City, waiving any other jurisdiction.
THIRTEENTH.- ALTERNATIVE MEANS. In the event that the Platform does not function properly or is unavailable, the User may contact Epicurus through the official contact methods available on the website, within established business hours.
